General terms and conditions

Our prices

All catalogue prices are in Swiss francs (CHF) including value-added tax but excluding postage and packaging costs on your part. This amounts to CHF 7.00 per order, whereby in the case of partial deliveries we only invoice this amount for the first delivery. Also with regard to our prices, the reservation of possible printing errors applies, which we cannot be held responsible for. Payment

You will receive your goods on the account and transfer the amount within 14 days from the invoice date (due date). A discount deduction is unfortunately not possible. Credits by advance payment or a later return will be credited to your customer account or refunded to you. In this case please inform us of your bank details. You can also deduct any credit balance from your next invoice.

Retention of title / reminder fees

All delivered goods remain the property of Bayoumi fair until full payment has been received. Bayoumi fair is entitled to make a corresponding entry in the respective retention-of-title registry. If a customer is in default with the payment of the purchase price, Bayoumi fair is entitled to withdraw from the contract by means of a declaration of withdrawal and to demand the handing over of the delivered goods.

You acknowledge with your order that Bayoumi fair will charge the following reminder fees in case of default of payment to compensate for costs incurred by the appropriate pursuit of our claims from the concluded contractual relationship: 2nd reminder CHF 8.00, 3rd and 3rd and 4th reminder additionally CHF 15.00 each. The costs and expenses of debt collection also include all out-of-court costs of a licensed debt collection agency, as well as any other costs such as lawyers’ fees, etc.

Exchange and return policy

You have the right to revoke the contract with us within 14 days of receipt of the goods and to return the goods to us within this period. The date of the postmark is decisive for timely dispatch. The costs for the return shipment are to be borne by you. You will receive a receipt free of charge from the post office when you post the goods. Please keep this receipt in a safe place, because in case of a lost parcel your return shipment can only be credited against the presentation of this receipt. We will refund any payments already made as soon as we receive the goods, but reserve the right to deduct or charge the replacement for any damage or excessive wear and tear from the amount to be refunded.

Packing / Risk-taking / Delivery time

We bear the risk of damage to the ordered goods until they are dispatched. The dispatch of the goods themselves is therefore at your risk and we cannot accept any liability for transport damage.

We ask for your understanding if, in exceptional cases, longer delivery times for individual items may arise due to delivery bottlenecks. We also ask for your understanding that we cannot assume any liability for such delays in delivery. Regarding your packaging costs, please see above under “Our prices”.

Warranty

Applicable law/place of performance/place of jurisdiction

These terms and conditions and all contracts concluded on the basis of these terms and conditions are subject exclusively to Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (CISG).

The place of performance and exclusive place of jurisdiction for all disputes arising in connection with these terms and conditions and all contracts concluded on the basis of these terms and conditions which are not considered consumer contracts within the meaning of Art. 32 Para. 2 ZPO is Zurich. However, bfair shall be free to sue its customers at any other place of jurisdiction that may be appropriate for them. For consumer contracts within the meaning of Art. 32 para. 2 ZPO, the provisions of Art. 32 para. 1 ZPO apply.

We process personal data for contract processing and maintenance of ongoing customer relations. Data protection is very important to us, which is why your personal data and all order information is treated with the utmost confidentiality and is only passed on to third parties to the extent that this is absolutely necessary for proper service provision (order processing). However, we expressly exclude the forwarding of your data for advertising purposes. As a customer, you expressly agree to this use of your data.
